DISCLAIMER/RELEASE AND INDEMNIFICATION

As used herein, “I”, “myself”, “me” and “my” means the participant signing below and all companions and family members traveling with participant who sign below.

As used herein,“OU” includes Orthodox Union and each of its affiliates, related entities, officers, trustees, employees, vol­unteers, members, agents, representatives, successors and assigns.

By registering and/or participating in all or part of any trips or activities organized by OU, including any travel to, from and within Israel (“Mission”), I agree to the following:

I acknowledge that I have been advised by OU of the issuance of a “Travel Warning” by the United States Department of State dated January 12, 2001 which provides, among other things:

The Department of State warns U.S. citizens to defer travel to Israel, the West Bank and Gaza. The U.S. Government has indications that there is a heightened threat of terrorist incidents in Israel, the West Bank and Gaza. In light of several recent terrorist bombings in Israel and continuing violence in Gaza and the West Bank, American citizens should exercise extreme caution and avoid shopping areas, malls, public buses and bus stops as well as crowded areas and demonstrations. U.S. Embassy and Consulate employees and their families have been prohibited from using public buses. American citizens should maintain a low profile and take appropriate steps to reduce their vulnerability.

Violent clashes and confrontations continue to take place throughout the West Bank and Gaza. U.S. Embassy and Consulate employees have been prohibited from traveling to the West Bank, Gaza, commercial districts of East Jerusalem, and the Old City of Jerusalem, except for mission essential business. Private American citizens should avoid travel to these areas at this time, and Americans residing in the West Bank and Gaza should consider relocating to a safe location, if they can do so safely.

From time to time, the U.S. Embassy or Consulate General will temporarily suspend public services as necessary to review its security posture. In those instances, U.S. citizens who require emergency services may telephone the Consulate General in Jerusalem at (972) (2) 622-7230 or the Embassy in Tel Aviv at (972) (3) 519-7355…

I have read and understand this Travel Warning and I have nevertheless decided to attend the Mission. I accept all risks associated with the heightened dangers of travel to, from and within Israel in connection with the Mission. I understand and agree that the OU shall not be responsible or liable, and I, for myself and on behalf of my family, next of kin, heirs and representatives, shall make no claim against OU, for any damage, injury, death, loss or expense resulting from travel to, from or within Israel or in connection with my attendance at and participation in, the Mission.

I acknowledge that OU advises me to purchase accident, baggage and trip cancellation insurance, and if I already own such insurance, or any other personal insurance, to check the terms of my insurance in light of the Travel Warning.

In consideration of my acceptance to attend and participate in the Mission, and for other good and valuable consideration the adequacy of which is hereby acknowledged, I, for myself and on behalf of my family, next of kin, heirs and representatives, release OU, and agree not to sue OU, from and regarding any and all claims and liability of any kind whatsoever, past, present and future, both known and unknown, including those which have not yet arisen or matured, whether in law or in equity, arising from, related to or in connection with travel to, from and within Israel and my attendance and participation in the Mission. This release includes, but is not limited to, claims for negligence or any intentional act on the part of OU or any other person or entity, and claims related to any hostile act, terrorism, social unrest, business interruption, theft, property damage or loss, government act or restraint, accident, injury, death, illness, disease, medical treatment, natural disaster, climatic condition, local laws, labor dispute, delay, anti discrimination laws, and any other cost, loss or expense of any nature whatsoever.

I agree to indemnify, defend and hold harmless OU from any and all claims, cost, damage, liability, loss and expense (including attorneys’ fees), arising from, related to or in connection with my travel to, from and within Israel and my attendance and participation in the Mission. This indemnification includes, but is not limited to, claims for negligence or any intentional act on the part of OU or any other person or entity, and claims related to any hostile act, terrorism, social unrest, business interruption, theft, property damage or loss, government act or restraint, accident, injury, death, illness, disease, medical treatment, natural disaster, climatic condition, local laws, labor dispute, delay, anti discrimination laws, and any other cost, loss or expense of any nature whatsoever.

I agree that this Disclaimer/Release and Indemnification and any and all issues related to it and/or the Mission are to be solely and exclusively governed by, and construed in accordance with, the laws of the State of New York, without giving effect to principles of conflicts of law. I agree that only the State or Federal courts located in the State of New York shall determine disputes arising from, related to or in connection with this Disclaimer/Release and Indemnification and/or the Mission and I consent to the exclusive exercise by such courts of personal jurisdiction over me and waive and agree not to assert any objection or defense based on lack of personal or subject matter jurisdiction or venue. If any term or provision of this Disclaimer/Release and Indemnification is declared invalid by a court of competent jurisdiction, the remaining terms and provisions of this Disclaimer/Release and Indemnification shall remain unimpaired and in full force and effect.

I have read, understand, and agree to be bound by all of the above.
